These Terms govern your access to and use of www.awakeneddomme.com (the “Website”), our email newsletters (the “Email Program”), and any SMS/text messaging program (the “SMS Program,” and together, the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services. 

1. Eligibility & Age Restriction 

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By subscribing or accessing the Website, you affirm this. If we discover a user under 18, we will promptly delete their information and terminate access. 

2. Privacy & Notice at Collection 

Our collection and use of personal information is described in our Privacy Policy. By using the Services, you consent to that Policy. This may include identifiers (such as name, email, phone), internet activity, commercial information, and—only if you voluntarily provide it—sensitive information such as sexual preferences. 

Certain disclosures (e.g., to advertising or analytics partners) may constitute a “sale” or “share” under U.S. state laws. You may opt out at any time via our Do Not Sell or Share My Personal Information link or cookie preferences tool. We also honor Global Privacy Control (GPC) signals where required. 

3. Cookies & Tracking 

We use cookies and similar technologies for functionality, analytics, and advertising. EU/UK users will only receive non-essential cookies if they consent. U.S. users can manage cookies and opt out of “sales/shares” through our preferences tool. 

4. Sensitive Information 

If you voluntarily provide information about your sexual orientation, erotic interests, or other sensitive personal information, we process it only for limited purposes you request (such as tailoring educational communications) and only with your consent where required. You may withdraw consent at any time. 

5. User Conduct 

You agree to: 

·        Use the Services only for their intended purposes. 

·        Respect the privacy and rights of other users. 

·        Refrain from uploading, posting, or distributing illegal, non-consensual, or harmful content. 

·        Comply with all applicable laws and regulations. 

Prohibited content includes but is not limited to: 

·        Any depiction of minors. 

·        Harassment, hate speech, threats, or exploitation. 

·        Non-consensual sexual content. 

·        Malware, spam, or attempts to circumvent security. 

6. Accounts (Website Only) 

If you create an account, you are responsible for maintaining confidentiality of your login information and for all activity under your account. Notify us immediately of any unauthorized use. 

7. Intellectual Property 

All Website and Email Program content is the property of TL Coaching, LLC or its licensors. You may not copy, redistribute, or modify it without permission. 

If you submit content, you grant TL Coaching a limited, worldwide, royalty-free license to host, display, and use it solely to operate, improve, and promote the Services. 

8. Communications – Email & SMS 

Email: By subscribing, you agree to receive marketing and informational emails. Every email includes our legal name, postal address, and an unsubscribe link, which we honor promptly. 

SMS: If you opt in, you consent to receive recurring automated promotional and personalized marketing text messages. Message & data rates may apply. Message frequency varies. Consent is not a condition of purchase. Reply STOP to cancel, HELP for help. Supported carriers are not liable for delayed or undelivered messages. You must be 18+. 

9. Disclaimers 

Content is provided for educational and informational purposes only. It does not constitute medical, psychological, legal, or therapeutic advice, and no provider–patient relationship is created. 

10. Security & Availability 

We use reasonable safeguards to protect your information and ensure availability. No system is 100% secure, and you use the Services at your own risk. 

11. Purchases & Refunds 

If you purchase events, courses, or subscriptions, you agree to the displayed pricing, taxes, and payment terms. Refunds and cancellation policies are as stated at the point of sale. 

12. Limitation of Liability 

To the fullest extent permitted by law, TL Coaching and its affiliates are not liable for indirect, incidental, or consequential damages. Our total aggregate liability for any claims will not exceed the greater of $100 or the amount you paid us in the 12 months before the event giving rise to liability. 

13. Indemnification 

You agree to indemnify and hold harmless TL Coaching and its affiliates from any claims or damages arising out of your misuse of the Services, your violation of these Terms, or your content. 

14. Governing Law & Dispute Resolution 

These Terms are governed by the laws of Texas, USA. 

Except for IP and small-claims matters, disputes will be resolved by binding arbitration in Austin, Texas. Both parties waive jury trial and class/representative actions. You may opt out of arbitration within 30 days by emailing tigresslily@awakeneddomme.com

15. Changes to Terms 

We may update these Terms at any time. Updates will be posted on the Website and/or sent by email or SMS. Continued use after changes constitutes acceptance.
